In a Chapter 7 proceeding, you are allowed to permanently rid yourself of these and other similar debts without making any payments on them, and you keep important and essential protected assets such as household goods, retirement accounts, vehicles, bank accounts, etc. The vast majority of individuals needing bankruptcy relief will qualify for Chapter 7 protection under the income guidelines known as the "Means Test". If you do not qualify, or if you have more assets than you are permitted to keep under Chapter 7, you may choose Chapter 13 relief. In Chapter 13 you will pay at least some portion, but not necessarily all, of your unsecured debt.
